a) Provision of the website and creation of log files

    • (1) Data processing

When our website is visited, our system automatically collects data and information of the computer system of the accessing computer. In this process, the following data will be collected:

  • IP address
  • Date and time of access
  • File transferred
  • Volume of data transferred
  • Whether access was successful
  • Processing time of access
  • Browser used/operating system used

The data will also be stored in the log files of our system. These data will not be stored together with other personal data.

    • (2) Legal basis

The legal basis for the temporary storage of data and log files is point (e) of Article 6(1), Article 6(3) of the General Data Protection Regulation in conjunction with section 3 of the Federal Data Protection Act (Bundesdatenschutzgesetz). The DPMA is responsible for receiving IP applications. To ensure secure electronic filing of applications, it is necessary to temporarily store the data and log files.

    • (3) Purpose of data processing

The logged data are used solely for the purpose of ensuring the security of the system and optimising the DPMAdirektWeb service, in particular for error analysis.
The temporary storage of the IP address by the system is necessary so that, in the event of attacks on DPMA systems, the origin of the attacks can be identified promptly and suitable countermeasures can be initiated.

    • (4) Duration of storage

The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. The duration of storage for the personal data processed in connection with an IP application is governed by an internal order of the German Patent and Trade Mark Office on the storage and destruction of documents, based on guidelines by the German government.

Personal data in the register or in publicly accessible electronic information services of the DPMA are of ongoing interest to the public, which is why they remain published.

    • (5) Option of objection and of removal

The collection of data for the provision of the website and the storage of data in log files is absolutely indispensable for the operation of the DPMAdirektWeb service. Therefore, there is no option to object.

b) Use of cookies

    • (1) Data processing

We use session cookies for our website. Cookies are text files that are stored in the Internet browser or by the Internet browser on your computer system. When you visit a website, a cookie may be stored on your operating system. This cookie contains a characteristic character string that enables a unique identification of the browser when the website is revisited.

    • (2) Legal basis

The legal basis for the processing of personal data using cookies is point (e) of Article 6(1), Article 6(3) of the General Data Protection Regulation in conjunction with Section 3 of the Federal Data Protection Act. You can use DPMAdirektWeb to electronically transmit information and documents on various IP rights to the German Patent and Trade Mark Office. For this purpose, it is necessary to buffer your entered data. Receiving IP applications is the duty of the DPMA.

    • (3) Purpose of data processing

The purpose of using session cookies is to buffer the entered data. This is necessary for technical reasons.

The user data collected by the cookies are not used to create user profiles.

    • (4) Duration of storage, option of objecting and of removal

Cookies are stored on your computer and transmitted by it to our server. Therefore, you as a user also have full control over the use of cookies. You can deactivate or restrict the transmission of cookies by changing the settings in your Internet browser. Cookies already stored can be deleted any time. This can also be carried out automatically. If cookies are deactivated for our website, it may be possible that not all functions of the website can be fully used. The cookies used will expire automatically after closing the browser.

    • (5) Rights of the data subject

c) Filing IP applications

    • (1) Data processing

On our website, users are given the opportunity to electronically transmit information and documents relating to various IP rights. For this purpose, the data is entered into an input form, transmitted to us and stored.
The following data are collected:

  • Name
  • Address
  • Telephone number (optional)
  • E-mail (optional)
  • Representative
  • Address for service
  • Information necessary for specifying the IP right (e.g. list of goods and services, representations, designers)
  • Data on bank details and/or preferred method of payment

Your personal data will be used to the following extent:

  • within the scope of pending procedures before the DPMA or in appeal proceedings
  • for the publication of a registered trade mark/registered design in the register, cf. section 41 of the Trade Mark Act (Markengesetz)/section 20 of the Design Act (Designgesetz)
  • for well-founded requests for file inspection (however, certain parts of the case file are excluded, if there is a conflicting legal provision or to the extent that your legitimate interest obviously prevails)
  • for the publication of trade mark and design applications as well as other potential IP rights whose processing requires publication or storage
  • within the scope of the supply of data on IP rights and IP applications in electronic form to third parties for purposes of trade mark information, cf. section 41(3) of the Trade Mark Act or for purposes of design information, cf. section 19(3) of the Design Act
  • within the scope of well-founded requests for administrative assistance
  • within the scope of the exchange of information with other international offices such as the EUIPO
  • for passing on data to banks for carrying out direct debiting of IP fees
  • in anonymised form for the statistics of the DPMA
  • for technical customer support and error analysis

Passing on data to third parties for other purposes, particularly for commercial purposes, is excluded.

    • (2) Legal basis

The legal basis for the processing of personal data within the scope of electronic filing of applications via DPMAdirektWeb is point (e) of Article 6(1), Article 6(3) of the General Data Protection Regulation in conjunction with Section 3 of the Federal Data Protection Act. It is the duty of the DPMA to receive information and documents relating to various IP applications and to grant, register, administer and publish IP rights, as well as to provide information on existing IP rights.

    • (3) Purpose of data processing

The collection and storage of personal data is necessary for processing the electronically filed information and documents. In addition, the DPMA fulfils its legal duty to provide information on IP rights valid in Germany to the public by means of its publication and search services available on the Internet. This also requires the processing of personal data.

    • (4) Duration of storage

The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. The duration of storage of your personal data in connection with the electronic transmission is governed by an internal order of the German Patent and Trade Mark Office on the storage and destruction of documents, based on guidelines by the German government.
