Design of the underside of a bicycle or motorbike saddle can be registered as a design

Last year, the European Court of Justice and the Federal Court of Justice also dealt with a registered design for a bicycle and motorbike accessory: In design invalidity proceedings, the courts had to examine whether the design of the underside of a bicycle or motorbike saddle could be eligible for protection. The invalidity applicant was of the opinion that the underside of the saddle was excluded from design protection pursuant to Section 4 DesignG, as it was not visible as a structural element of a bicycle or motorbike during its "intended use" - riding.

However, the courts interpreted the term "intended use" very broadly, so that actions upstream and downstream of the main purpose (e.g. storage or transport of the saddle) could also be covered. This broad understanding has created greater clarity regarding the protectability of components of complex products and significantly strengthened design protection for such products.

And the time change greets us again and again
Who turned the clock?

Just a moment ago we changed it to "summer time" in the hope of a fresh, bright spring and long, bright, balmy summer evenings. And bang, it's October again and we turn the clocks back again at the end of the month. All of a sudden it's dark very early again.

Whether alarm clocks, wristwatches or egg timers, they are set forward in spring and back in autumn. And this has been the case for over 40 years. By the way, you can find many exciting designs in DPMAregister. Fortunately, we don't have to reset all these timepieces every time, too.

The pet market is booming: according to the German Pet Supplies Industry Association (Industrieverband Heimtierbedarf e.V.), total sales in the German pet industry in 2022 were around 6.5 billion euros. Almost half of all households had at least one pet in 2022. There is also barking and meowing in the design register.
